Terms of Service

These terms govern your use of the TCHAT platform, and by using the service you agree to them. The service is intended for commercial organisations, not individuals.
1. The service
The platform enables businesses to communicate with their customers through messaging channels, and to manage and follow up on that communication. We may develop the service, add to it, or discontinue parts of it, and we aim to give prior notice of material changes.
2. Your account
When registering you must provide accurate, current information, keep your login credentials confidential, and notify us as soon as you suspect unauthorised access to your account. You are responsible for activity under your account. You must be at least 18 and authorised to contract on behalf of your business.
3. Your messaging channel account
The account you message your customers from is your own. We manage the technical connection to it on your behalf and do not own it. You may disconnect the platform from it at any time, and our access ends immediately.
You must comply with the policies of the channel provider you use. Any action it takes regarding your account, or any limit it places on your sending, is its decision and not ours, and we bear no liability for it.
4. Subscription and costs
The platform subscription is recurring and renews according to the agreed plan. The plan's details, price and period are set out when you subscribe.
Your use may also incur costs payable directly to other parties. Those are outside your subscription with us: we do not collect them, add to them, or control how they are priced. If they go unpaid, your sending may stop even while your subscription with us remains active.
You may cancel at any time, effective at the end of the paid period. Amounts paid for a current period are non-refundable unless the law provides otherwise.
5. Acceptable use
The following are prohibited:
- Sending marketing messages without the recipient's prior consent
- Ignoring requests to stop messages — these are honoured immediately, without exception
- Using contact details obtained without their owners' permission
- Fraud, phishing, or impersonating another party
- Any content violating the laws of the Kingdom or the policies of messaging channels
- Attempting to access another business's data or to compromise the platform's security
- Reselling access to the platform or sharing your account with third parties
You are responsible for your customers' data and for obtaining their consent to marketing communications; we process that data on your instructions. Any claim arising from messages sent without consent rests with you alone.
6. Suspension and termination
We may suspend or terminate the service where these terms are violated, where payment is overdue, where use harms the platform, other clients or system security, or where a competent legal authority so requires. We aim to give prior notice where possible, except in cases of imminent security risk or legal compulsion. In all cases you may request a copy of your data during the retention period.
7. Service level
We make reasonable efforts to keep the service available, and do not guarantee uninterrupted operation. Maintenance, or failures at parties outside our control, may affect it. Message delivery, its speed and its limits rest with the messaging channels themselves, so we do not guarantee delivery of any particular message.
8. Limitation of liability
The service is provided “as is”. We are not liable for indirect or consequential damages, for lost profits or business opportunities, or for any action a third party takes against your account with it.
In all cases our total liability shall not exceed the amount you actually paid to the platform in the twelve months preceding the incident. This does not limit liability that cannot lawfully be excluded.
9. Intellectual property
The platform, its software, design and brand are ours. Your data and your customers' data are yours: we claim no ownership over them and do not use them for our own purposes, and the licence you grant us is limited to what is necessary to operate the service for you.
10. Privacy
Data processing is governed by our Privacy Policy, which forms an integral part of these terms.
11. Changes to these terms
We may amend these terms and will notify you of material changes a reasonable time before they take effect. Continued use of the service after that constitutes acceptance.
12. Governing law
These terms are governed by the laws in force in the country where the company is established, and its courts have jurisdiction over any dispute arising from them. We seek to resolve disputes amicably first.
